Terms of Service

Welcome to EnglishDee (“we”, “us”, “our”). These Terms govern your use of our LMS platform at https://englishdee.com.

By using EnglishDee, you agree to these Terms. If you are a teacher, you also accept responsibility for your students’ compliance. Our Privacy Policy and Cookie Policy form part of these Terms.

1. Eligibility and Accounts

• Teachers: You must be at least 18 years old and have the legal authority to use EnglishDee with students, including the authority to act on behalf of your school or educational institution.
• Students: If you are under 18, you may only use EnglishDee through a teacher’s class. You represent that your teacher has obtained the necessary parental permission. If you are under 13, you may not create an account without teacher-invited access.

2. Teacher Attestation (Parental Consent Responsibility)

When creating a class or generating a class code, every teacher must check an unavoidable attestation box. By doing so, the teacher certifies:

• They have obtained all required parental or guardian consents under applicable local laws (including COPPA, GDPR, PDPA, and others) for each student under 18 in the class.
• EnglishDee will be used solely for educational purposes as part of the teacher’s curriculum.
• Parents have been provided with clear notice about EnglishDee’s data practices (collection of voice recordings, written answers, and basic account information).
• The teacher will retain documented proof of parental consents and provide it to EnglishDee upon request.
• The teacher agrees to indemnify EnglishDee as set forth below.

EnglishDee stores a record of each attestation (timestamp, IP address, version).

3. Teacher Indemnification (Full Liability Shift)

The teacher agrees to indemnify, defend, and hold harmless EnglishDee, its owner, and its service providers from any and all claims, liabilities, fines, penalties, damages, and expenses (including reasonable legal fees) arising out of or related to:

• The teacher’s failure to obtain any required parental consent or school authorization;
• The teacher’s violation of any data protection or child privacy law;
• Any parent or guardian complaint regarding the collection, use, or storage of student data;
• Any regulatory action or fine imposed on EnglishDee that results from the teacher’s acts or omissions.

EnglishDee’s total liability for any claim arising from lack of parental consent shall be limited to the amount paid by the teacher (if any) in the preceding 12 months. The teacher acknowledges that EnglishDee relies entirely on this attestation and indemnification and would not provide the service without these terms.

Nothing in this section requires a teacher to indemnify EnglishDee for EnglishDee’s own breach of applicable law, and nothing in these Terms limits any rights that cannot be waived under mandatory consumer or data protection law.

4. Subscriptions, Payments and Renewals

• The core LMS (classes, assignments and collecting student work) is free, with no credit card required. AI features are available during a 30-day free trial (no credit card required) and afterwards on a paid subscription.
• Paid AI plans are priced by the number of students linked to your account: up to 150 students — $10/month ($100/year), up to 300 students — $15/month ($150/year), and up to 450 students — $20/month ($200/year). Yearly billing is charged for 10 months (2 months free). For more than 450 students, contact us for a custom plan. Prices may vary by region and are shown at checkout.
• Students are counted as the distinct students enrolled in your classes; the number of classes is not limited. Your plan must cover your current number of students, and you can only switch to a plan that covers your roster.
• Paid subscriptions renew automatically (monthly or yearly, as selected) until cancelled. Payments are processed by Stripe, and you authorize us (through Stripe) to charge your payment method on each renewal.
• Promotional discounts, where offered, apply to all plans except the $10/month (up to 150 students) plan.
• You may cancel anytime from your dashboard; access continues until the end of the paid period.
• Except where required by law, refunds are not provided for unused portions of a subscription period.
• We may change prices. We will give you at least 30 days’ notice by email before a price change applies to your subscription, and you may cancel before it takes effect.

5. Acceptable Use and Prohibited Conduct

You may not:

• Use EnglishDee for any unlawful purpose.
• Upload malicious code or attempt to disrupt the service.
• Harass, bully, or discriminate against others.
• Upload content that violates intellectual property rights.
• Attempt to access data belonging to other teachers, students, or classes, or misuse the AI features.

6. AI Features and Disclaimer

EnglishDee uses artificial intelligence to provide automated feedback. AI feedback may contain errors and is not a substitute for professional teacher judgment. We disclaim all liability for any inaccuracies in AI-generated feedback.

7. Intellectual Property

All code, branding, and design of EnglishDee are owned by us. Teachers retain ownership of their assignments and lesson content. Students retain ownership of their original submissions.

8. Account Suspension, Termination and Deletion

You may stop using EnglishDee and request deletion of your account at any time. We may suspend or terminate an account if these Terms are breached, if required by law, or to protect the service or other users. Where practical, we will give notice before termination.

Students may delete their own submissions (written answers, voice recordings and listening answers) from their account. A submission can be deleted before it is graded. Once a submission has been graded, or a recording has been transcribed, the student may remove the recording file while the grade, transcript and feedback are kept. Deleting a submission or recording does not delete the account or the class record. Teachers and, where applicable, parents may also request deletion of student data as described in our Privacy Policy.

Teachers may delete a class or an individual assignment from their dashboard; both actions require an explicit typed confirmation. Deleting a class permanently deletes that class’s assignments and the students’ submissions for those assignments (including recordings and grades), and removes the students from that class — the students’ accounts are kept. Deleting an assignment permanently deletes the students’ submissions for that assignment (including recordings and grades). Certificates that have already been issued are not affected by deleting a class or assignment.

9. Disclaimer of Warranties

EnglishDee is provided “as is” and “as available”. We do not warrant that the service will be uninterrupted, error-free, or secure against all possible breaches.

10. Limitation of Liability

To the fullest extent permitted by law, EnglishDee’s total liability to you shall not exceed the amount you paid us in the previous 12 months. In no event shall we be liable for indirect, incidental, or consequential damages, including lost teaching time or student data breaches arising from your own failure to secure accounts.

11. Changes to These Terms

We may update these Terms. We will notify teachers by email and post a notice on the platform 30 days before changes become effective, and update the version and date at the top of this page. Continued use constitutes acceptance.
